Program Basics and Process
The U.S. government’s Immigrant Investor Program provides foreign nationals with an opportunity to obtain U.S. permanent residency (also known as a “Green Card”) for themselves, their spouse and all unmarried children under the age of 21.
The process for gaining a Green Card through the EB-5 program can be simplified to the following steps:
Step 1.
Select Project
Review the available projects and speak with project specialists all for free.

Step 2.
Identify and Work with Immigration Attorney
Work with an immigration attorney to prepare your ‘Source of Funds’ documentation and application package.
Incorrect Source of Funds documentation is the biggest reason that people are denied an EB-5 Visa. Investors want to make sure to work with an immigration attorney that has experience with dealing with Source of Funds documentation from their home country as there are unique challenges from each country.

Step 3.
Invest and File
Invest the funds into the US government approved project and file the application.
The US government will not process your application until the full investment is in place.

Step 4.
Process
The US government will process your application. Depending on when you invest and file, and depending on the project, your application could be approved in as little as three months, though the average approval is closer to 18 months.

Step 5.
Return of Funds
The investment must stay in place for approximately five years (specifics will vary based on your project selection). At which time, the Regional Centers will look to return investor funds. Some with interest and some without depending on the project investment terms.
That’s it! You get to keep your US Permanent Residency forever and even apply for American citizenship and passport if you so wish.

Program History and Milestones
As the program grows in popularity worldwide – total yearly EB-5 Investment passes 5 Billion USD for the 2016/2017 fiscal year. This represents an increase in demand worldwide with investors from China, Vietnam, Brazil, and India accounting for 96% of total EB-5 investors.

In 1993, Congress created the Immigrant Investor Pilot Program to increase interest in the EB-5 visa program. This new pilot program established EB-5 Regional Centers. Today, investment through regional centers accounts for 98% of all investment.
Chinese investors continued to grow in numbers. In 2014, they reached their highest number, accounting for 85% of global market. This massive demand has resulted in a 12-year wait for late-to-act Chinese investors.
