EB-5 I-829 Approval Rates from 2008 to end of fiscal year 2018
The latest USCIS* data release shows that the EB-5 program has one of the highest approval rates of all migration visas. I-526 Approval Rates historical average around 85%. Its I-829 counterpart is even higher at around 96% last year.
Unlike an I-526 petition, there are two reasons that an I-829 can be denied. One reason is that the investor has failed to keep the investment ‘at risk’ for the required time.* If the investor withdrew their funds prematurely from the Regional Center, they will be denied. Alternatively, if USCIS classifies the investment as not ‘at risk’, the investor will be denied.
The high approval rates show that USCIS policy is clear on what is acceptable and not and as such experienced attorneys and regional centers guide the investors correctly.
