An increasing number of Indian entrepreneurs and professionals, both those living in and out of the United States, have begun applying for the EB-5 investor visa. Recent updates to the structure of the H-1B visa have caused concerns among the employment-based immigrant community, over 70% of which originate from India. In the past year, the government has begun proposing stricter guidelines for the H-1B visa, which may have contributed to the decline in H-1B visa approvals for petitioners from India.
One of the newly proposed restrictions would see the spouses of H-1B visa holders, who hold H4 visas, prohibited from working in the United States legally. Currently, the H4 visa allows the spouses of H-1B visa holders to both live and work alongside their partners. Under the new proposed regulations, H4 visa holders will be barred from working – a move that would cause incredible financial strain for many immigrant households. Although no official decision has been made regarding the employment eligibility, Indian immigrants have been looking for immigration alternatives that allow their spouses to continue working in the United States.
The EB-5 investor visa has been the answer for a large number of Indian immigrants that are currently holding H-1B visas or are exploring their permanent visa options from outside of the country. The EB-5 visa is considered the ‘investor visa’ due to its baseline requirement for a minimum investment into a US government-approved project that will employ at least ten US workers. The EB-5 investor visa is currently the fastest permanent immigration option for foreign nationals. In addition to being the most fast-tracked route, the EB-5 visa has fewer requirements than most of the other permanent options available, which makes it ideal for immigrants that may not have the familial or educational requirements that other visas demand. EB-5 visa recipients and their eligible family members receive conditional green cards and are permitted to remove their conditional status after two years.
